SHEL'TTER WEB STORE (the "Site") is intended to service our customers by selling brands of Baroque Japan Ltd. and is run by YOU inc ("YOU").

Please review the following terms and conditions of use, which govern your use of the Site (the "Agreement").
Your use of the Site constitutes your agreement to follow and be bound by the Agreement.

Please also check and agree on the "Notes and information regarding your shopping at our Site" section (Japanese) before you shop at the Site.

1. General Rules
[1] The Agreement is subject to customer ("Customer") who visit or shop at the Site.
[2] Selling, delivering, and support of products on SHEL'TTER WEB STORE are for those within Japan only.
(For overseas shipping, please contact Tenso.com.)
[3] We reserve the right to update or modify this Agreement at any time without prior notice.
[4] In order to use this Site, customer registration is required. Please be aware that shopping at the Site will complete in customer registration when you submit your order.

2. Privacy
[1] We may use your personal information for the following purposes:
(1) To process and fulfill your order such as shipment and payment
(2) To communicate with you and to send you information about our products, services, life events and cultures
(3) To analyze trends and statistics on new products and product renewals
(4) To operate other duties related to the above
[2] In order to provide you with good service and smooth operation of duties, we may share necessary and limited personal information to Baroque Japan Ltd. and/or other trusted companies who work on behalf or with YOU.
We will supervise and administer these companies not to make any other use or disclosure of your information.
[3] We will not provide your personal information to third party except: on circumstances mentioned in [2] above; when you agreed on the disclosure; to comply with laws or regulations, or to protect life or important property of YOU or others.
[4] We would like to keep your personal information as accurate and updated as possible.
Please contact our customer service regarding disclosure of personal information, updates on your information, and on service suspension.
We will make necessary correspondence to your request after your identification is confirmed.
[5] We will not hold responsible for information deleted from our system due to unexpected system problems or at times of disasters.

3. Information on the Site
[1] We try our best in keeping the information on the Site as accurate and clear as possible, however there may be typographical errors or words/phrases that may cause misunderstanding against to our will.
Your use of the Site is at your sole risk, and you assume full responsibility for any costs associated with your use of the Site.
YOU shall not be liable for any damages or loss of any kind related to your use of the Site.
[2] Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. Due to this, we may not be able to process your order even after you have submitted your order. If this shall happen, we will contact you with the accurate information and ask you for your will to purchase.
[3] We have made every effort to display as accurately as possible the colors of our products that appear at the Site.
However, we cannot guarantee that your computer monitor's display of any color will be accurate, thus will not accept any request or demand related to this issue.

4. Purchasing of our Product
[1] We do not accept any cancellations, changes, or requests to combine multiple shipments after you have submit your order even prior to shipment.
[2] Our product is only available when there is stock available.
[3] If we shall find any damage to the product you purchased, we will, without notice, cancel your order of that defective product and send the rest of the items, if any. We will contact you if that defective product is the only item you purchased.
[4] We may limit to one product for each Customer to purchase on limited items. Each regular item is available up to three for each Customer.
We may refuse of selling if your order includes more than three products of the same item.
[5] We may refuse to accept orders from those Customers who purchase our products for resale, or with frequent requests of returns or refusals to accept delivery of purchased items.
[6] Regular shipment will take 3-5 working days to arrive at Tenso.com after you submit your order. For those items that may take extra delivery time, such as limited items or prior reservation items, estimated arrival date will be noted on the Site.
[7] For regular items on SHEL'TTER MOOK sale period, estimated delivery time to Tenso.com is less than 2 weeks counting from the day after your order is submitted.
However, it may take longer if intensive number of orders are placed or around holidays.
[8] We may contact you to confirm your order if there are multiple shipments send to same address or the amount of purchase is more than JP 100,000 yen.
In these cases, delivery may take longer for we will ship out your purchased items after we confirm the order with you.
[9] If you are under 20 yrs. old, you will use and shop at this Site under the approval of your guardian.
[10] Refusing to accept your ordered delivery for no eligible reason is not acceptable.
We may refuse to offer any further service if you neglect on receiving your delivery or fail to receive your delivery due to long-term absence.
[11] The price on the Site at the time of your purchase will be the price we charge you, unless there is a typographical error on the price.
We will not return any amount of price difference generated by bargain sales or accept cancellation after you have submit your order even prior to shipment.

5. Returns and Exchanges
[1] Returns and exchanges are not acceptable unless the product is defective, there is a damage caused by delivery, there is a mistake in packaging, or other reasons caused by another company. Return or exchange product must be reported to our customer service within 3 working days after arrival.
YOU is not liable for any other situations mentioned above regarding return or exchange products.
[2] Products subjected to OUTLET or SALE may have small damages or stains. Please consider it carefully when purchasing.
We do not accept any returns or exchanges unless we admit that the product is clearly defective.
Please also be aware that DENIM products subjected to OUTLET or SALE are not subjected for size exchanges.

6. Disclaimer
[1] The materials on the Site are provided "as is" without warranties of any kind.
[2] YOU is not liable for any damage or loss brought to our Customer or to another third party caused by using the Site or by the contents of the Site unless the reason of the damage or loss being on YOU or companies working on behalf or with YOU.
[3] We may suspend or stop our service without prior notice or approval on the following situations and will not hold responsible for damages or loss caused by this suspension or stop.
(1) Periodical system maintenance and updates, and at times of emergency
(2) Difficulty providing our service during unavoidable circumstances such as fire, power outage, and natural calamity
(3) Difficulty maintaining to provide our service due to other unexpected situations
[4] We use certain security measures to protect the personal information you submit to the Site.
For example, when you provide any order information, we use Secure Socket Layer (SSL) technology, an encryption tool that provides security while transmitting this information over the Internet. We also use other technological and procedural safeguards in maintaining the Site.
Although we have implemented the above security measures for this Site, you should be aware that 100% security is not possible.
[5] We will not hold responsible on any damage or loss caused by personal information leak, deleted data, or falsified data manipulated by third party, otherwise caused by YOU or by companies working on behalf or with YOU.

7. Others
[1] In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the Site, or the breach, enforcement, interpretation, or validity of this Agreement or any part of it ("Dispute"), the party asserting the Dispute and YOU will try in good faith to settle such Dispute by discussion and conference.
[2] Any dispute arising under this Agreement and by using the Site shall be resolved exclusively by the supreme court of Japan, in accordance with the Japanese laws and regulations.
